Terms of Service

These Terms of Service (Terms) govern access to and use of FICE Medical, a clinical management platform and client portal provided by LandA Apps.
By accessing or using FICE Medical, you agree to these Terms. If you use FICE on behalf of a clinic or other organization, you represent that you are authorized to bind that organization.

1. The service
FICE Medical is software for healthcare organizations to manage clinical, administrative, and related workflows, and a client portal for patients and other individuals authorized by a clinic.
FICE Medical is not a healthcare provider. LandA Apps does not practice medicine, provide medical advice, or make clinical decisions. Clinical judgment remains solely with licensed professionals and the clinic.
2. Accounts and authorized users
Clinics are responsible for:
- Authorizing workforce and portal users
- Maintaining accurate account information
- Safeguarding credentials and devices
- Using roles and permissions appropriately
You must be authorized by the relevant clinic (or by LandA Apps, for vendor administration) to use the service. You may not share accounts or attempt to access another person’s account.
3. Clinic responsibilities
The clinic is responsible for:
- Clinical care, documentation quality, and professional licensure of its workforce
- Obtaining patient consents and authorizations required by law
- HIPAA Covered Entity obligations, including its Notice of Privacy Practices
- Configuring FICE to match its policies
- Any use of third-party code sets and terminologies in production, including required licenses
FICE does not guarantee emergency care, diagnosis, or treatment outcomes.
4. Acceptable use
You may not:
- Use the service for any unlawful purpose
- Interfere with security, availability, or other users
- Upload malware or attempt unauthorized access
- Misrepresent your identity or authority
- Use the service in a way that violates a clinic’s policies or applicable law
The service is not a substitute for contacting emergency services.
5. Protected health information
Where FICE processes PHI, it does so as a Business Associate on behalf of the clinic, subject to a Business Associate Agreement where required. See our Privacy Policy.
Telehealth and messaging features, if enabled by a clinic, are tools for care delivery. They do not create a treatment relationship with LandA Apps.
6. Third-party standards and terminologies
FICE may incorporate or reference healthcare standards and terminologies (for example LOINC, SNOMED CT, ICD-10-CM, CPT, HCPCS, NPI/NPPES, NUCC taxonomy, and UCUM). These systems are not all free or public domain.
In particular:
- CPT is copyrighted by the American Medical Association and may be used only under applicable license.
- SNOMED CT is subject to SNOMED International affiliate, national, or sublicense arrangements and depends on territory.
- Other code sets remain subject to their official licenses and notices.
Production use of licensed content is the clinic’s and LandA Apps’ responsibility under the applicable agreements. Details and attributions are listed in About FICE Medical → Licenses & Attributions in the applications. Authoritative licenses are those published by the relevant organization, not these Terms.
7. Intellectual property
LandA Apps and its licensors own FICE Medical, including software, documentation, and branding. These Terms do not transfer ownership. Clinics and users receive only the limited right to use the service as offered.
You retain rights in content you lawfully submit, subject to the license needed for FICE to host and process that content to provide the service.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, LANDA APPS DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
FICE does not warrant uninterrupted or error-free operation, or that the service will meet every clinical or billing requirement.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LANDA APPS AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM USE OF THE SERVICE.
This section does not limit liability that cannot be limited under applicable law, including where a Business Associate Agreement provides otherwise for PHI.
10. Suspension and termination
We may suspend or terminate access for breach of these Terms, legal risk, non-payment (where applicable), or to protect the service and users. Clinics may stop using the service according to their commercial agreement with LandA Apps.
11. Governing law
These Terms are governed by the laws of the United States and the laws of the jurisdiction of LandA Apps’ principal place of business, without regard to conflict-of-law rules, except where a written master agreement with a clinic specifies otherwise.
12. Changes
We may update these Terms. The effective date and version above will change when we do. Material changes may be communicated through the service or by email where appropriate. Continued use after an update constitutes acceptance, except where law requires otherwise.
